Refund Policy

1 - Product Characteristics

1.1. The Purchaser may purchase Standard Products, which include:

1.2. The prices of Standard Products will always be available on the Website, as will those of the paints to be combined to obtain a Customized Product.

1.3. The characteristics and quality of the Products are contained in the technical sheets of the Standard Products, available at any time on the Website, and are fully applicable to Customized Products as well.

1.4. The images and descriptions of the Products on the Website reproduce the real characteristics of the Products as faithfully as possible. However, the customized colors shown on screen may differ from the real ones due to the settings of the IT and/or telematic systems or the computers/peripherals used by users to view them, as well as the lighting conditions of the environment in which the Website is used. These images must therefore be understood as merely indicative.

2 - Shipping and Delivery

2.1. Vernice undertakes to physically deliver the Products, with simultaneous transfer of possession to the Purchaser - as well as any resulting liability or risk - within no more than thirty (30) days from the conclusion of the Sales Contract. In case of delay beyond this deadline, the Consumer Purchaser will have the right to urge Vernice to make the delivery within an additional period appropriate to the circumstances. If Vernice does not deliver the goods within this additional period, the Consumer Purchaser will have the right to terminate the Sales Contract.

2.2. Delivery will take place at the address indicated in the order form and during office hours, so it is advisable for the Purchaser to indicate an address where someone is always available to receive the goods.

2.3. After the completion of the Purchase Order, the Purchaser will have the option to modify it on the Website within the following thirty minutes, maintaining the effectiveness of the Order; the Purchaser will also be given the opportunity to communicate the change of address directly to the designated carrier, once the Product has been delivered to them and compatible with the conditions applied by the carrier.

2.4. At the time of delivery of the goods by Vernice to the carrier, the latter will communicate their details to the Purchaser via e-mail and a link to track the shipment, also indicating where to find the applicable transport conditions, which will govern the shipment subject to the Order. Any requests for information or complaints regarding delays must be communicated directly to the carrier using the contact channels indicated in the above-mentioned e-mail.

2.5. Vernice cannot be held responsible for any delays in the delivery of the Product if it has promptly made it available to the sender, nor for non-delivery resulting from causes dependent on non-collection, incorrect or incomplete entry of the address, or other causes of force majeure or otherwise beyond its control.

2.6. At the time of delivery, the Purchaser is required to verify - in the presence of the carrier - the number of packages and the condition of the packaging, taking care to also check that it is intact and not in any way damaged and/or wet, including in the closure materials, as well as the condition of the contents.

2.7. In case the Purchaser finds any problem, they must report it immediately by noting it on the appropriate delivery receipt. Receipt of the shipment by the Purchaser, without any written notice of damage on the delivery receipt, will constitute a presumption of delivery of the goods in good condition.

2.8. Any claim for damage, shortages or delays due to shipping must be communicated in writing to the carrier as soon as possible and in any case within the deadlines indicated by the same in the applicable conditions referred to in art. 5.4 above. The Purchaser undertakes to keep available to the carrier all cartons, packaging and original contents in order to allow an inspection of the disputed shipment.

2.9. The Purchaser waives any objection if the damage to the outer packaging was caused by an inspection by the competent authorities.

3 - Right of Withdrawal by Consumer Purchaser

3.1. Based on the definitions of Professional and Consumer set forth in the Definitions, in compliance with European and Italian regulations, only the Consumer Purchaser (and not the Professional Purchaser) has the right to withdraw from the contract concluded with Vernice, without the need to provide any reason and without any penalty, by written communication to be made within 14 (fourteen) days from the day on which the Consumer Purchaser, or a person other than the carrier designated by the Purchaser, acquires physical possession of the Standard Product.

3.2. The Consumer Purchaser is given the right to exercise the right of withdrawal only with reference to the Standard Product, but not also to the Customized Product possibly purchased, due to the exemption provided for by art. 59, lett. c) and d) of the Consumer Code, as they are consumable and/or perishable and/or clearly customized goods, since the Customized Product is created following the Purchaser's instructions, so it is not prefabricated but produced according to an individual choice or decision, therefore incapable of being regenerated and to be understood as a "made-to-measure" good.

3.3. In permitted cases, the Purchaser will be required to communicate to Vernice their intention to exercise the right of withdrawal by completing and sending the appropriate Withdrawal Declaration, to be completed directly through the Website within the above-mentioned period of 14 days from receipt of the Standard Product.

3.4. Vernice will in any case promptly communicate to the Purchaser - via e-mail - confirmation of receipt of the withdrawal communication.

3.5. The Purchaser loses the right to exercise the right of withdrawal if the Standard Product has been removed from the packaging and/or opened and/or used and/or damaged, or is otherwise no longer in good condition.

4 - Effects of Consumer Purchaser Withdrawal

4.1. The exercise of the right of withdrawal terminates the obligations of the Parties to perform the contract, while various mutual obligations remain pending until the relationship between the Parties can be considered definitively concluded.

4.2. Purchaser's Obligations:

4.2.1. The Purchaser undertakes to return the Standard Product to Vernice s.r.l., via Maccaferri n. 2/A, 40069, Zola Predosa (BO), Italy, without undue delay and in any case within fourteen (14) days from the date on which they communicated their decision to withdraw from the contract pursuant to this Agreement.

4.2.2. The Purchaser must arrange for the return of the Standard Product using a carrier of their choice and undertakes to bear the full cost. The Standard Product must be returned intact and in its original packaging and wrapping. The Purchaser is responsible for the successful return, of which they will be informed by Vernice.

4.3. Vernice's Obligations:

4.3.1. Vernice will have the right to withhold the refund until it has received the return of the Standard Product from the Purchaser, or until the consumer has demonstrated that they have returned the goods, whichever occurs first.

4.3.2. Vernice undertakes to refund to the Purchaser all payments made by the Purchaser within no more than fourteen (14) days from the day on which the withdrawal declaration was received, or in accordance with the provisions of Article 7.3.1 above. The refund will be made using the same means used by the Purchaser for the initial transaction.

4.3.3. If upon receipt of the return Vernice finds damage to the Product, it will notify the Purchaser within three (3) working days of receipt. In this case, the Standard Product will be made available to the Purchaser for its return - in any case at the Purchaser's expense - simultaneously canceling the withdrawal request, with the consequence that the refund procedure will be interrupted, if not yet completed, and will be revoked (with consequent obligation of payment by the Purchaser), if already completed.

5 - Liability

5.1. For any breach of the terms of this contract by the Purchaser, the Purchaser will be liable to the injured party.

5.2. No liability shall be attributable to Vernice in case of increased costs due to requests for any reason made by customs of the destination country, the amount of which will remain the responsibility of the Purchaser.

5.3. In case of non-acceptance, even partial, for any reason, of an order, the Purchaser will not be entitled to any compensation or indemnity of any kind, just as any hypothesis of non-contractual liability on the part of Vernice for any direct or indirect damage to persons or things must be excluded.

5.4. Vernice will not be liable for the failure to perform any of its obligations under this document if such failure is caused by natural disasters, riots, strikes, fires or other unforeseeable events beyond its control. If the force majeure event continues for a period of 3 (three) months, each of the Parties will have the right to terminate this contract.

5.5. Vernice will not be liable for any direct or indirect damage caused by the Product if these are caused by improper, imprudent or negligent use of the same.

5.6. Vernice will not be liable for loss of profits, contracts or other indirect and/or consequential damages arising from the use of the Website and the Service. Within the limits of the provisions of law, any liability allegedly attributable to Vernice will in any case be limited to the value of the Order and the amount paid by the Purchaser.

6 - Complaints, Warranty and Order Cancellation

6.1. Without prejudice to the right of withdrawal referred to in arts. 6 and 7 above, the Purchaser has the right to report, comment on or submit any complaint regarding the service provided by Vernice, not only for any non-conformity of the Products delivered, but also for any other reason relating to the sale of the Products and/or the Service, by contacting ciao@vernice.it, which undertakes to respond via e-mail exclusively in Italian or English (depending on the language of the complaint) within 7 days of receiving the complaint.

6.2. Products sold on the Website are covered only by the legal warranty, lasting two years in the case of a Consumer Purchaser and one year in the case of a Professional Purchaser.

6.3. In order to enforce the warranty, the Purchaser is required to scrupulously verify the integrity of the goods and the existence of the promised requirements and, in case the Product does not conform to that of the Order, to make without delay, and in any case within eight (8) days of discovery, the appropriate complaint to Customer Service, attaching photographic documentation and a description of the alleged lack of conformity.

6.4. In case of an ascertained lack of conformity, the Purchaser will have the option to decide whether to request the shipment of goods conforming to the Order, in replacement of the defective ones, or to cancel the Order and request a refund of the price paid.

6.5. To assess the possible existence of the lack of conformity and its causes, Vernice will primarily take into account the nature of the good, as well as the nature of the alleged lack of conformity, the documentation received from the Purchaser as proof of the alleged defect, and the time elapsed between delivery and the complaint.

6.6 In any case, Vernice reserves the right to withdraw the allegedly defective product to verify its characteristics at its own laboratories, in which case it will proceed with the replacement of the Product or the cancellation of the Order, depending on what the Purchaser has requested, exclusively in the event that the reported defect is attributable to its own responsibility.

6.7. Upon verification of the defect on the product, Vernice undertakes to send a replacement item, or to cancel the Order (and consequently to fully refund to the Purchaser the amount paid for the purchase of the defective Product), depending on what the Purchaser has requested.

6.8 Grounds for exclusion from the conformity warranty pursuant to art. 129 of the Consumer Code and also prevent cancellation of the Order include: a. improper or non-compliant use of the Product; b. defects and consequences arising from non-compliant use of the Product; c. defects and consequences arising from external causes; d. purchase of Products from a source other than the Website.
